The Legal Nature of International Treaties and Their Influence on Rights and Obligations for Third States

Никто не оспаривает тот факт, что в основе международно-
го права лежит обязательный характер международных договоров. Однако
все еще остаются трудности в отношении вопроса об их обязательности для третьих стран. Прямо или косвенно любое действие отражается на всех го-
сударствах в условиях глобализации. В первой части статьи рассматривает-
ся норма об обязательном характере для договаривающихся сторон, вторая и
третья части направлены на исследование исключений из данного принципа,
используя в качестве примеров действующие международные договоры.
В первой части рассматриваются статьи 35 и 36 ВКПМД, а также пример из
практики МС ООН и ППМП.
Основная идея данной работы раскрывается во второй части, где обсужда-
ются два важных положения, а именно, положение, регулирующее принцип
РНБ и второе — необходимость применения оговорки, основанной на приме-
нении права другой стороны, т.е. имплементация национального стандар-
та, закрепленного в статье 1121 Гражданского кодекса Франции, когда полу-
чателю не нужно давать согласие, чтобы стать кредитором должника по
договору.
Завершающая часть освещает некоторые аспекты международного терри-
ториального права в отношении нейтральных государств и общего наследия
человечества. В конце ставится вопрос о тирании большинства на междуна-
родной арене.
The binding effect of international treaties is the foundation of International
Law that nobody challenges. However, the question about their binding effect for third
states poses a major difficulty. Indeed, due to globalization every action influences
all states directly or indirectly. The main issue of the first part of this paper is to
dwell on the rule of the binding effect on contracting parties, the second and the third
parts are aimed at elucidating exceptions to this principle and exemplifying by means
of effective treaties.
The first part briefly covers Article 35 and Article 36 of the VCLT with some examples
from the jurisprudence of the ICJ and PCIJ.
The main idea of the paper is highlighted in the second part of the paper where two
crucial clauses are discussed, namely — the clause regulating the most— favorednation
principle and the second clause devoted to the necessity to apply the stipulation
for another, i.e the implementation of a domestic standard enshrined in Article 1121
of the French Civil Code, when the recipient does not need to consent to become
a creditor of the promisor.
And the last but not the least in its importance is the third part devoted to some aspects
of international territorial law with regard to neutral states and common heritage
of mankind. The paper concludes with the questioning of the tyranny of the majority
on the international scene.
