Historical Causation of Universal Attributes of a Jury Verdict in Criminal Proceedings

Автор рассматривает историческую обусловленность осново-
полагающих признаков вердикта как процессуального решения, исследуя опыт
развития суда присяжных в Англии в XIII—XVII вв. В статье выделяются зна-
чимые периоды развития суда присяжных и обусловленность принимаемых ре-
форм историческими процессами, развитием государства и системы уголов-
ной юстиции. Так, на основе изучения работ английских авторов выделяются
три этапа, в рамках которых вердикт приобретал современные юридические
свойства. В первый период (XIII—XV вв.) вердикт присяжных был признан ре-
шением, определяющим существо уголовно-правового спора, имеющим крат-
кую форму ответа на поставленный вопрос. Во второй период (XV—XVI вв.)
вердикт становится решением, вынесенным на основе свободной оценки до-
казательств, а не деятельности самоинформированной коллегии. В это же
время происходит закономерный этап противостояния между присяжными
и коронным судьей, который в третьем периоде (XVII в.) заканчивается при-
знанием общей идеи о невозможности оценки обоснованности вердикта со
стороны судьи и доктрины юридической безответственности присяжного за
вынесенное решение. По мнению автора, дальнейшее развитие суда присяж-
ных в России должно основываться на понимании логики и значимости дан-
ных свойств вердикта присяжных как неотъемлемых признаков самого ин-
ститута суда присяжных заседателей.
The author examines the historical causation of the development of fundamental
elements of the jury verdict serving as a procedural decision by means
of exploring the development of the jury service in England in XIII-XVII centuries.
The paper highlights the key periods of jury trial development and the causation of
the reforms predetermined by historical processes, development of the State and the
system of criminal justice. Thus, based on the study of the works of English authors,
the author determines three stages at which the jury verdict acquired modern legal
features. During the first period (in XIII-XV centuries), the verdict of the jury was recognized
as a decision determining the essence of the criminal law dispute that takes
the form of a brief answer to the question raised. During the second period (in XV-XVI
centuries), the verdict transfers into the decision made on the basis of independent
evaluation of the evidence, rather than the work carried out by the self-informed jury
panel. At the same time a logical stage of confrontation between the jury and the
Crown judge comes to prominence that, during the third period (XVII century) ends
with the recognition of the general idea of impossibility of determining the validity of
the verdict by the judge and the doctrine of juror’s legal irresponsibility for the decision
passed. In the author’s opinion, the further development of the jury trial in Russia
should be based on the understanding of reasoning and significance of these features
of the jury verdict as inseparable elements of the institute of the jury.
