  1. Обзор отражает результаты работы круглого стола «Проблемы международного право- судия» в рамках VII Московской юридической недели. В рамках работы круглого стола был сделан акцент на значительном росте числа судебных органов ин- теграционных объединений и неоднородности «кон- цептуальной основы», заложенной в функции и суще- ство их деятельности. В суде неотъемлемо и одновременно воплощаются две ипостаси: органа международного правосудия и органа интеграции. Участниками были затронуты независимости международного суда и судей; «законности» выносимых судебных решений (на предмет соответствия их международному праву), обязательности их исполнения и «исполнимости» в целом; презумпции эквивалентности; признания судебных решений; «злоупо- требления» особыми мнениями; выполнения Судом ЕАЭС функции по «охране» «права Союза» (отсутствуют необходимые полномочия и инструментарий); отсутствия четких правил подведомственности и подсудности междуна- родных судов; вопросы международного правосудия в Европе; трансформации судов; конкуренции судов и конкуренции толкований; требований двойной ло- яльности для судей; состояния и перспектив рассмотрения спортивных спо- ров в ЕСПЧ; возможности конституционного контроля Конституционным Судом РФ актов ЕАЭС и др.


  2. The review reflects the results of the Round Table “Problems of International Justice” held within the framework of the VII Moscow Legal Week. In its work the Round Table focused on a significant growth in the number of judicial authorities of integration associations and heterogeneity of the “conceptual basis” laid down in the function and essence of their activities. The tribunal inherently and simultaneously reflects two capacities: as a body of international justice and as a body of integration. The participants elucidated and focused on the independence of the International Court of Justice; “legitimacy” of passed judicial decisions (concerning their compliance with International Law), their mandatory enforcement, and their “enforceability” as a whole, presumptions of equivalence; recognition of judicial decisions; “abuse” of dissent opinions; the implementation of EEU Court functions to “protect” the “law the Union” as there are no necessary powers and tools; lack of clear rules of jurisdiction of international tribunals; issues of international justice in Europe; transformation of tribunals; competition between courts and interpretations; the requirements of dual loyalty applied to judges; the status and perspective of sports disputes in the ECHR; possibility of the constitutional review of the EEU instruments exercised by the Constitutional Court of the Russian Federation, etc.
